Court Gives Ok for UnConstitutional Sale of GM

The Unconstitutional Seizure and Sale of Chrysler by the Federal Government has set a precedent that has allowed the Unconstitutional Seizure and Sale by the Federal Government of GM. According to a Judge in New York, the Now Government Run GM will be allowed to sell it's "Assets" to a "New" Company that is also owned by the Federal Government. It's a Shell Game....

This is an attempt by the Federal Government and the Administration to make it appear the Government did not take over General Motors but "Bought" it from them. This might convince the uneducated, but the Fact that the Federal Government already negotiated the Sale of GM's European Division of Opel and the SUV Division of Hummer without a single GM Representative being Present several weeks ago, shows the Federal Government had already "seized" GM.

According to an Article on Fox News.com not everyone is giving up without a fight:

"attorneys for some of GM's bondholders, consumer groups and individuals with lawsuits against the company argued in court for its rejection, saying that their needs were being pushed aside in favor of the interests of GM and the government."

Some may ask how the Seizure and sale of GM and Chrysler were Unconstitutional.

Well according to the 4th Amendment:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

In the Case of Chrysler and GM, the Federal Government Seized the Property of the two Car makers without a Warrant and with No Probable Cause. The Property of the two car makers Legally belonged to those whom they Legally owed money to according to Contracts(Bondholders, Etc..), as is described in Corporate Bankruptcy Law. The Federal Government Does Not Have the Right to Take Private Property Just Because they want to......Even if the Company Owes the Federal Government Money due to the "Bailout", there is No Contract that specifies and allows the dismissal of the Property Rights to those whom it legally belongs. If this was the case, then any person who has Ever Received Money from the Federal Government in the form of a Loan or Handout will be subject to the Federal Government seizing their Private Property in lieu of Re-Payment.

But the fact they have done it with the two Big Car makers, means they Can do it to anyone......

Until the Supreme Court Declares the Seizures as Unconstitutional.....they can take anything from anyone and base it on these Two Unconstitutional Precedents.....
